These Terms of Service ("Terms") govern your access to and use of the Nora Health pharmacy app, website, and related services (the "Services"). By creating an account or using the Services you agree to these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 18 years old to create a Nora Health account. By creating an account you represent that the information you provide is accurate and that you are legally able to enter into a binding contract.
2. Medical disclaimer
Nora Health is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard medical advice or delay seeking it because of something you read in the app. In an emergency, call your local emergency number immediately.
3. Prescriptions
- You may only upload prescriptions issued in your name or in the name of a dependent for whom you are legally authorized to act.
- Our licensed pharmacy team reserves the right to review, refuse, or transfer any prescription, in accordance with applicable law and professional judgment.
- Controlled substances are subject to additional verification and may not be available for delivery.
- You agree to provide accurate medical, allergy, and insurance information.
4. Orders, payment & deliveries
- Product availability, pricing, and delivery times may change without notice.
- Payments are processed by Stripe. You authorize us to charge your selected payment method for the total amount of your order, including applicable taxes and delivery fees.
- Same-day delivery is offered only within designated service areas and is subject to courier availability.
- Risk of loss passes to you when the order is handed off to you or your designated recipient.
- Refunds and returns of OTC products are handled in accordance with our return policy. Prescription medications generally cannot be returned for safety reasons.
5. Acceptable use
You agree not to:
- Use the Services for unlawful, fraudulent, or harmful activity.
- Interfere with or attempt to gain unauthorized access to any part of the Services.
- Impersonate another person or misrepresent your affiliation with any person or entity.
- Resell, reverse-engineer, or attempt to extract source code from the Services.
6. Account security
You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us immediately at team@mynorahealth.com if you suspect any unauthorized use.
7. Intellectual property
Nora Health and its licensors own all rights, title, and interest in and to the Services, including all software, logos, content, and trademarks. These Terms do not grant you any rights to our intellectual property except a limited, revocable, non-transferable license to use the Services for personal, non-commercial use.
8. Disclaimers & limitation of liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NORA HEALTH DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NORA HEALTH AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
9. Termination
We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may close your account at any time by contacting team@mynorahealth.com. Sections that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) will continue to apply.
10. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict of laws rules. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas for any dispute arising under or in connection with these Terms.
11. Changes
We may revise these Terms from time to time. Continued use of the Services after revisions take effect means you accept the updated Terms.
